Terms of Service

1. Acceptance of Terms

Welcome to RestaurantOS ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our multi-tenant SaaS application, including any related websites, APIs, kitchen displays, and POS integrations.

By registering an account, deploying a workspace, or using any part of our platform in India, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are entering into this agreement on behalf of a restaurant entity, you represent that you have authority to bind that entity.

2. Account Registration & Security

Under Section 43A of the Information Technology Act, 2000, you are responsible for maintaining the confidentiality of your credentials (emails, passwords, and API tokens). You must provide accurate, current, and complete details during signup.

We reserve the right to suspend or terminate accounts that provide fraudulent information or perform unauthorised actions. You agree to notify us immediately at restaurantos@navneettechlabs.com (cc: official@navneettechlabs.com) of any security breaches or unauthorized use of your restaurant tenant workspace.

3. Trial Period & Data Risks

We offer a 14-day Free Trial period for owners to configure menus, tables, and test the digital ordering workflow.

⚠️ IMPORTANT WARNING: The Free Trial workspace operates as a temporary testing sandbox. During this trial period, the services and data are provided strictly on an "AS-IS" and "AS-AVAILABLE" basis:

  • Automated backups are NOT enabled for trial tenants.
  • There is a high risk of data loss due to system testing, migrations, or database maintenance.
  • Uptime SLAs do not apply to free trial accounts.
  • We strongly advise against using free trial accounts for live restaurant operations or commercial orders. We accept no liability for data loss during the trial.

4. Service Level Agreement (SLA)

Upon upgrading to a paid subscription plan (Starter, Business, or Enterprise), the platform guarantees the following protections:

  • Automated Backups: Daily automated incremental backups are enabled and securely stored on Tier-III compliant cloud servers located in the Mumbai region (AWS/Azure/GCP India).
  • 99.9% Uptime SLA: We guarantee a 99.9% application uptime, excluding planned maintenance windows.
  • Data Recovery: Paid plans get priority restoration support to recover database states in the event of hardware or system failures.

5. Fees & Payments

Subscription prices are billed monthly in Indian Rupees (INR) through Razorpay. All fees are exclusive of GST, which will be added at checkout.

If payment fails, we reserve the right to suspend dashboard access after a 7-day grace period. Subscriptions can be downgraded or cancelled via your billing settings. Cancelled paid subscriptions will retain access until the end of the current billing cycle, after which backups will be retained for a maximum of 30 days before deletion.

6. Prohibited Actions

You agree not to modify, hack, or reverse-engineer the API, kitchen displays, or client ordering pages. Any attempts to bypass subscription gating checks, inject malicious code, or scrape data from partner restaurants will result in immediate termination of service and reporting to the appropriate cyber crime authorities under the IT Act, 2000.

7. Intellectual Property

All code, design systems, illustrations, templates, and backend architecture are the exclusive property of RestaurantOS. Restaurant owners retain ownership of their uploaded menu content, logo, and branding images.

8. Jurisdiction & Grievances

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
